British couple checking their passport while considering a visitor visa extension in South Africa

A visa extension allows a foreign national who is already lawfully present in South Africa to apply for additional time in the country before their existing visa expires.

It is not granted automatically. It is an application submitted to the Department of Home Affairs, which decides whether the applicant has provided a sufficient reason and meets the requirements for a further period of stay.

The application is ordinarily submitted through a VFS Global Visa Facilitation Centre in South Africa.

Is a visa extension the same as changing your visa?

No.

An extension means asking Home Affairs to extend an existing visa for the same purpose. For example, a person admitted as a visitor may apply for additional time to continue that visit.

A change of status means applying for a different visa category. This could involve changing from a visitor’s visa to a work, study, relative’s or another type of visa.

South African immigration law places significant restrictions on changing visa status from inside the country. Qualifying for an extension does not mean that a person may change to another visa category.

Can anybody apply for a visa extension?

No.

The applicant must hold a valid visa, and the particular visa category must allow an extension from within South Africa.

Some visas are renewable or extendable, while others are subject to specific restrictions. The conditions printed on the visa and the legal requirements applying to that category must therefore be checked before an application is started.

Can a visitor’s visa be extended?

A visitor’s visa issued under section 11(1)(a) of the Immigration Act may be extended for a further period, subject to the prescribed requirements and approval by Home Affairs.

The applicant must explain why additional time is required and provide supporting evidence. Holding a valid visitor’s visa does not create an automatic right to an extension.

Home Affairs may approve the application, approve a shorter period than requested or refuse it.

What are the 60-day and seven-day rules?

Timing is critical.

Under regulation 9(9) of the Immigration Regulations, an application to renew or extend a visa must generally be submitted in person at least 60 calendar days before the visa expires.

Where the visa was issued for fewer than 30 days, the application must be submitted no later than seven working days before its expiry.

These are legal submission periods. They should not be treated as optional administrative guidelines.

Waiting until the last minute creates unnecessary risk. Documents, appointments and payment arrangements should be prepared well before the deadline.

How does the application process work?

Step 1: Check the current visa

Confirm the visa category, expiry date and conditions attached to the visa.

The visa must still be valid when the application is submitted. The particular visa category must also permit an extension from within South Africa.

Step 2: Confirm the submission deadline

Determine whether the 60-calendar-day rule or the seven-working-day rule applies.

If the ordinary deadline has already passed but the visa remains valid, the matter should be assessed immediately. A late application is not the same as an application made after the visa has expired.

Step 3: Prepare the supporting documents

The documents required will depend on the visa category and the reason for requesting additional time.

A visitor’s visa extension may require:

  1. A valid passport.
  2. A copy of the current visa.
  3. A written explanation of why the additional stay is required.
  4. Proof of sufficient financial means.
  5. Proof of accommodation.
  6. A return or onward flight reservation.
  7. Evidence supporting the purpose of the extended stay.
  8. Any additional documents required by Home Affairs or VFS Global.

The passport must meet the applicable validity requirements and should contain sufficient blank pages.

Step 4: Complete the online application

The applicant must complete the appropriate temporary residence visa application through the VFS Global system.

The information provided must be complete and consistent with the passport, existing visa and supporting documents.

Step 5: Pay the applicable fees

The required Home Affairs application fee and VFS service fee must be paid, where applicable.

Fees can differ according to the application category and the applicant’s nationality. Proof of payment should be retained.

Step 6: Book a VFS appointment

Once the online application and payment process has been completed, the applicant must book an appointment at a designated VFS Global Visa Facilitation Centre in South Africa.

Appointment availability can vary, which is another reason not to wait until the submission deadline is approaching.

Step 7: Attend the appointment

The applicant must ordinarily attend the appointment in person with the required supporting documents and passport.

VFS receives the application on behalf of Home Affairs. VFS does not decide whether the extension will be granted.

Step 8: Keep proof of submission

The applicant should retain the VFS receipt and a complete copy of the application.

The application can then be tracked through the VFS system while Home Affairs considers it.

Does submitting an application guarantee approval?

No.

VFS Global receives the application, but the Department of Home Affairs makes the decision.

Acceptance by VFS does not mean that the legal requirements have been satisfied. Home Affairs may request additional information, approve the application for a shorter period or refuse it.

Applicants should avoid making non-refundable arrangements based solely on the assumption that an extension will be approved.

What happens if you apply late or your visa expires?

A late application is not the same as an expired visa.

VFS may accept an extension application submitted outside the applicable 60-day or seven-day period, provided the applicant’s existing visa is still valid. However, acceptance by VFS does not mean that the late submission complies with the legal deadline or that Home Affairs must approve it.

Once the visa has expired, an ordinary extension application cannot be submitted. VFS will not accept the application as a way of repairing the overstay.

The person may then be regarded as an illegal foreigner, and leaving South Africa after overstaying may result in a declaration of undesirability.

Anyone who has missed the deadline or whose visa is approaching expiry should obtain professional advice immediately.

Can you remain in South Africa while the application is pending?

A person who has submitted an extension application should retain the VFS receipt and a complete copy of the application.

Processing delays can result in the existing visa expiring before Home Affairs has decided the application. The VFS receipt is proof that an application was submitted, but it is not a replacement visa.

The applicant should obtain professional advice if the existing visa expires while the application remains pending.

Can you leave South Africa while the application is pending?

If the existing visa has expired while the extension application is still pending, the applicant should not leave South Africa.

Leaving after the visa has expired may result in the person being declared undesirable, even though an extension application was submitted before expiry and remains undecided.

The VFS submission receipt does not prevent a declaration of undesirability and does not guarantee that the person will be permitted to return to South Africa.

Can you work while waiting for an extension?

Submitting an extension application does not give the applicant new rights.

The person remains bound by the conditions of the existing visa. A visitor who is not authorised to work does not acquire work rights merely because an extension application has been submitted.

No person should work, study or conduct business unless their visa expressly permits that activity.

How long does a visa extension take?

The process is intended to be completed within approximately 60 days. This is one of the practical reasons applicants are required to submit most extension applications at least 60 calendar days before their existing visas expire.

In practice, however, processing periods are inconsistent. Some applications are decided sooner, while others remain pending beyond 60 days.

Submitting an application within the prescribed period therefore gives Home Affairs time to process it, but it does not guarantee that a decision will be issued before the existing visa expires.

Frequently asked questions

Can I apply after the 60-day deadline?

VFS may accept the application if the visa is still valid, but the application will be late. Acceptance does not guarantee that Home Affairs will overlook the missed deadline or approve the extension.

Can I apply after my visa has expired?

No. An ordinary extension application cannot be submitted after the visa has expired.

Does booking a VFS appointment before expiry protect me?

No.

The application must be properly submitted before the visa expires. Creating an online profile or booking an appointment is not the same as submitting an application.

Can I extend a 90-day visitor’s visa for another 90 days?

An extension may be requested, but the additional period is not automatic. Home Affairs determines whether the extension should be granted and for how long.

Can I change from a visitor’s visa to another visa inside South Africa?

In most cases, a person holding a visitor’s visa cannot change to another visa category from within South Africa unless a specific statutory exception or recognised exceptional circumstance applies.

An extension and a change of status are different applications.

Can I travel if my visa has expired while my application is pending?

Leaving South Africa after the visa has expired may result in a declaration of undesirability, even if an extension application is pending.

The applicant should not leave South Africa without first obtaining professional advice.

Can Gema Visa Services assist?

Yes.

Gema Visa Services can assess the current visa, calculate the applicable submission period, determine whether an extension is legally available and assist with preparing and submitting the application.

Where the ordinary deadline has been missed, the visa is approaching expiry or the proposed application involves a possible change of status, the matter should be assessed without delay.

Contact Gema Visa Services before the visa expires so that the available options can be properly considered.
